The Partido Pirata (official abbrevation: PIRATA) is the pirate party of Spain.

Status

The party has been created on July 17 2006, officially founded on December 6 2006 finaly aproved by Ministry of Interior on January 22 2007.

Culture and Author's Rights

  • "Culture is one of the goods that every citizen has right to access; then, not only we do consider that free cultural collective exchanges and enjoyment are not a crime, but also we do consider it as a fair and efficient way of promoting culture"
  • "We will work to make spanish laws concerning copyright and defense, promotion and spread of culture compatible both author's rights with society's rights, leaving behind concepts like intellectual property, which we consider a nonsense because of the inmateriality of that supposed property and which, due to that supposed simmilarity with conventional property, may give preference to economic interests rather than to the citizens' enjoyment of the culture, instead of reconciling both interests"
  • "In accordance with the former, we reject the formulas of indiscriminate compensatory remuneration, also called canon, of private copies, and we reject a rights management model where authors are forced to transfer those rights under harmful conditions to their own interests; instead, we introduce the absolute obligation of bringing authors the right to choose between self-managing their own performance rights or choosing to work with one of several performance rights organisations; and we seek to open a dialogue between each of the implicated collectives and the society, in order to find proper solutions that satisfy all sides"

Civil Rights and Liberties

Non core issues treatment

  • Article 25.a.2, PIRATA's Statute: "For the other subjects outside the party goals, in accordance with the disposed on the article 2 of the present Statute, by default the members of the Institutional Groups will abstain; in order to decide in which cases there will be exceptions to that abstentionism, citizens with the right to vote will also be enfranchised with the right to vote and have voice, in accordance with the norms and procedures defined by internal rules. This submission to the citizens' will implies that "PIRATA" will not be part in any coalition government, nor will give inconditional support to any of the parties represented on the chambers of the different parliaments where "PIRATA" obtains paliamentary representation"
  • There is a pending internal rule, called Institutional Groups Rule, which apart from regulate parliamentary groups -from a national context; the EU context would be regulated through PPI-, would regulate how the exceptions declared in the article 25.a.2 of PIRATA's Statute would be handled

ILCs

  • The way for citizens to command PIRATA's representatives outside the core issues; a PIRATA approach to liquid democracy

Who

Voters
  • Depending on who has the right to vote within a political context:
    • For Spanish issues, all Spanish citizens with the right to vote
    • For autonomous issues, all the inhabitants of that autonomous region with the right to vote
    • For regional issues, all the inhabitants of a specific island, province, etc, with the right to vote
    • For local issues, all the inhabitants of a specific town with the right to vote
PIRATA
If PIRATA has representatives in the political context of the proposed ILC
  • The PIRATA's MPs would present the ILC as a proposal of their own in the corresponding parliament, and would vote for it
If PIRATA has no representatives in the political context of the proposed ILC
  • PIRATA would first try the corresponding procedures defined by initiative regulating laws -like article 87.3 of Spanish Constitution-
  • If that laws don't allow PIRATA to present the ILC outside the corresponding parliament, or if the ILC is not passed by the MPs from that parliament, PIRATA would include that ILC as a proposal of its own in the platform for the next election for that political context

Dual individual/collective initiatives
  • An ILC can be proposed either by an individual or by a collective
Three-part requirement
Enough support
  • Everything is going to be about citizens supporting or rejecting ILCs -individually or via associations-; for a ILC to be adopted and assumed as one of its own by PIRATA, enough citizens must participate in the corresponding consultation
Enough consenssus
  • In order to avoid one of common rejections of democracy, the so called tyranny of the majority, it won't be enough for a ILC to be adopted and assumed as one of its own by PIRATA to have only one more signature for than against. Consenssus -the concrete
Compliance with PIRATA issues
  • As PIRATA follows and will follow "the Spanish Political Parties Organic Law, and the rest of legal procedures", for instance, no inconstitutional laws would be adopted by PIRATA -it would be noticed to the ILC author/s that such ILC should be rewritten as a constitutional amendment-.
  • Proposals against PIRATA core issues will be rejected -no matter (though it would be quite worrying) if 5 million signatures claim for an ethnic cleansing, it goes against article 2.a.10 of PIRATA's Statute; or if (it would be also quite worrying) 5 million signatures claim for the allowance of 72-hour non-stop torturing methods to get statements from suspects at police stations, it goes against article 2.a.9 of PIRATA's Statute; etc-.
